That the Agriculture and Rural Affairs Committee recommend Council approve an amendment to the former Rideau Township Zoning By-law to change the zoning of 2909 Cowell Road from A2 to RE as shown in Document 1 and detailed in Document 2.

BACKGROUND

The subject land is located on the north side of Cowell Road, East of Malakoff and West of McCordick Road.  The Committee of Adjustment granted severance of this parcel from 2886 Mackey Road.  The new parcel will be known as 2909 Cowell Road.  The surrounding lands are rural in nature. The subject site is treed.

 

Existing Zoning

 

The current zoning is A2 (General Rural).  The A2 zone requires a minimum lot area of 35 hectares and a minimum lot frontage of 150 metres.

 

Purpose of Zoning Amendment

 

The proposed Zoning By-law Amendment will permit a decision of the Committee of Adjustment to finalize. The conditional approval by the Committee of Adjustment supports creation of a lot with 60 metres of frontage and 1.02 hectares in area.

 

 

DISCUSSION

 

Official Plan 

 

The subject land is designated Rural Natural Features in the Official Plan.

 

Rural Natural Features are natural areas in the rural area that contain woodlands, wetlands, and wildlife habitat that were identified by the Natural Environment Systems Strategy. 

 

The policies provide that where new construction is permitted on a lot that lies partially within the boundaries of a designated area, the new construction and on-site servicing will be located outside the boundary of the feature to the greatest extend possible and disturbance of the natural feature will be minimized.  In this case the lot is entirely within the Rural Natural Features designation.

 

The Official Plan policies provide that any development involving the creation of more than one lot must be supported by an Environmental Impact Statement demonstrating that development can occur with no adverse impact on significant ecological features and functions in the natural feature. Creation of one lot is permitted by severance within the Rural Natural Features designation, without the need for an EIS.

 

The Conservation Authority reviewed the applications for consent and rezoning and did not object to the severance in the proposed location or the proposed rezoning.  The Conservation Authority advised the applicant that the site is within a sensitive natural area and care should be taken to minimize vegetation removal for the creation of building and sewage system envelopes, and to maintain the natural drainage patterns through appropriate drainage. The development envelope should be placed close to the road to limit the intrusion into the natural features. The Conservation Authority did not request the zoning to address the location of future dwellings.

 

The zoning is therefore deemed to conform to the Official Plan Policies.

 

Details of Proposed Zoning

 

Rideau Zoning By-law

 

It is proposed placing the severed parcel in an RE (Estate Residential) zone which will set the minimum lot frontage to 60 metres and the minimum lot area to 0.8 hectares.  The rezoning will clear one of the conditions of consent and permit the severance to finalize.  The RE zone will permit a single dwelling house as a permitted residential use on the parcel.

 

New Comprehensive Zoning By-law

 

The Comprehensive Zoning By-law was passed by City Council on June 25, 2008. 

 

The Comprehensive Zoning By-law zones the land to RU (Rural Countryside Zone) The Rural Countryside Zone recognizes a minimum lot width of 50 metres and a minimum lot area of 0.8 hectares for lots to be used for residential purposes.  The lot created will have a lot width of 60 metres and a lot area of 1.02 hectares. As such no amendment to the Comprehensive Zoning By-law is required.

 

 

RURAL IMPLICATIONS

 

The rezoning supports rural development providing a variety of choice in housing opportunities in the city.

 

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy.  The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.
